Terms and Conditions of Participation in Auditions

PART A: TERMS AND CONDITIONS
1. Eligibility Requirements
In order to participate at the audition and, if your audition is successful, in Our Perfect Wedding Presenter Search, the participant warrants that he/she:
1.1 is 25 years and above should have turned 25 at date of audition;
1.2 is a South African citizen or has permanent residence status in South Africa at the time of the audition;
1.3 is available for the duration of the filming of Our Perfect Wedding in November and December 2017;
1.4 does not have a criminal record and has not been convicted of any criminal offence in a court of law (save for minor traffic offences);
1.5 is willing to provide the Organisers with their personal information including, but not limited to, full name/s and surname, identity number/passport number, age, physical residential address and telephone numbers, certain medical information, etc.;
1.6 at the request of the Organisers, will provide proof that he/she meets any or all of the entrance requirements set out in this clause 1 (Eligibility Requirements); and
1.7 undertakes to abide by these terms and conditions and complete the questionnaire truthfully and to the best of his/her ability.
2. Participation in the audition
2.1 As part of the audition, you will be required to audition before a panel of judges whose decision as to whether or not the individual will proceed to Our Perfect Wedding is final. No deliberations may be entered into and no decisions may be taken on review.
2.2 No person will be considered to host Our Perfect Wedding unless they have attended an audition.
2.3 Attendance at the audition constitutes the individual’s binding acceptance of the terms and conditions contained in this document.
2.4 The dates, venue and nature of the auditions will be broadcast on Mzansi Magic Channel (DStv Channel 161).
2.5 By attending the audition, you grant the Organisers (together with the Organisers’ successors, assigns and licensees) the right to use all footage, photographs and sound recordings featuring the participant that are recorded during the audition for use in Our Perfect Wedding Presenter Search (and to be broadcast on television and/or other media). This includes any cut-downs, variations, stills (complete or in parts) and all use of the participant’s images, names, voices and other identifying characteristics and the participant agrees that no amount will be paid to them by the Organisers in respect of the aforesaid.
2.6 No person will be entitled to any payment or counter-performance whatsoever by the Organisers in return of their participation in an audition.
2.7 The Organisers, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with Our Perfect Wedding Presenter Search and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter the audition or Our Perfect Wedding as a host.
3. Selection for Our Perfect Wedding Presenter Search
3.1 After the audition, individuals will only be contacted by the Organisers if they are shortlisted and/or selected to participate in Our Perfect Wedding.
3.2 Individuals that have been selected to participate in final phase of the Our Perfect Wedding Presenter Search will be contacted by the Organisers telephonically on or before 22nd September 2017.
3.3 Should an individual not have heard from the Organisers by 22nd September 2017, that individual can assume he/she has been unsuccessful.
3.4 Should an individual be selected to participate further in Our Perfect Wedding Presenter Search, such individual will be required to be available to the Organisers for the duration of the filming of final phase of Our Perfect Wedding Presenter Search which will be from 22nd October 2017 to the 25th October 2017. The individuals will be required to be available to the Organisers at all reasonable times during this period.
3.5 Should an individual be selected to participate in the final phase of Our Perfect Wedding Presenter Search, the Organisers shall cover transport costs to get the individual to Johannesburg (including return back to each relevant participant’s place of residence). The mode of transport, itinerary as well as any further travel arrangements shall be at the Organisers’ sole discretion.
3.6 Individuals will be required to reside in accommodation designated by the Organisers for the duration of the filming of the final phase of Our Perfect Wedding Presenter Search. Board and lodging in the aforesaid accommodation shall be for the account of the Organisers.
3.7 No fee, cost, remuneration or reward of any nature, whatsoever, shall be payable by the Organisers to any participant in Our Perfect Wedding Presenter Search directly or indirectly for whatsoever reason.
3.8 It is the individual’s responsibility to ensure that any information provided is accurate, complete and up to date and the Organisers shall not be liable for any errors and/or omission in any information submitted by a participant.
4. Intellectual Property
4.1 Each participant consents to the Organisers making a fixation of such person’s appearance and performance in the audition and, if relevant, Our Perfect Wedding Presenter Search (“Performances”), as well as any other images and/or sounds featuring the individual, in any media (for example, television, film, photograph, video tape, etc.) in which the Performances have been wholly or partly recorded or captured, including any reproduction or adaptation thereof, and the broadcast thereof, as such terms are understood in terms of the Performers’ Protection Act 11 of 1967 (as amended from time to time), for the purposes of Our Perfect Wedding Presenter Search, the promotion thereof and the promotion of the participant. Each participant further agrees that the Organisers and/or DSTV Media Sales Proprietary Limited may use his/her name, image, likeness, any photograph, voice, sobriquet and signature in connection with his/her audition and/or participation in Our Perfect Wedding Presenter Search for any purpose whatsoever. Copyright and intellectual property in the recorded performance shall be held by Electronic Media Network (Pty) Ltd (M-Net)
4.2 Each participant agrees that the Organisers shall have the sole and exclusive right to use, exploit, publish, reproduce, perform or otherwise deal with all material featuring the Performances for or in connection with the exploitation, broadcast, exhibition, marketing, promotion, distribution, production and sales of Our Perfect Wedding Presenter Search, in perpetuity and throughout the world.
4.3 The participant waives any moral rights that he/she may have to the Performances and any broadcasts thereof.
4.4 The Organisers are under no obligation to use or broadcast the whole or any part of the Performances in the audition.
4.5 The Organisers may alter, adapt, make additions to or otherwise edit the Performances at their sole discretion.
4.6 To the extent necessary, each participant hereby assigns, transfers and cedes all his/her rights, title and interest in and to the Performances to the Producers, free of charge.
5. Non-Disclosure
5.1 Each participant hereby undertakes to treat as strictly confidential all information of any nature whatsoever related to Our Perfect Wedding Presenter Search and these auditions that has been obtained or may be obtained, directly or indirectly, from participation in the auditions howsoever such information may be disclosed including, without limitation, whether oral, visual, written, digital, electronic, or any other form.
5.2 Each participant agrees that he/she will not disclose such said confidential information by any means whatsoever, including verbal discussion, social and other media for a period of 12 (twelve) months from the date the last episode of Our Perfect Wedding Presenter Search is aired by M-Net.
5.3 To give effect to the above, each participant hereby undertakes to use all reasonable steps to keep any confidential information which is in physical form (including in electronic media) secure.
5.4 Each participant agrees that the above undertaking shall continue to be of full force and effect regardless of whether he/she is selected for any audition or to be the host of Our Perfect Wedding.
6. General
6.1 The Organisers will not be responsible, and disclaim any and all liability, for any loss, liability, injury, expense or damage (including direct, indirect, incidental, punitive or consequential loss) of any nature, whether arising from negligence or any other cause, which is suffered by any participant or any other third party as a result of his/her participation in this call to entry and/or participation in the audition and/or use by the participant, of anything relating to this call to entry and/or audition and/or by any action taken by the Organisers or any of its affiliates in accordance with these terms and conditions and/or whether arising from the participant’s infringement or violation of any third party rights including intellectual property rights.
6.2 The Organisers reserve the right to vary, postpone, suspend, or cancel this call to entry and/or any audition and/or any aspect thereof, without notice, at any time, for any reason which the Organisers deem necessary, in their sole determination. In the event of such variation, postponement, suspension or cancellation, each participant agrees to waive any rights, interests and expectations that he/she may have in terms of this call to entry or audition and acknowledge that he/she will have no recourse against the Organisers.
6.3 Under no circumstances shall the Organisers and/or its affiliates be liable for, and each participant indemnifies the Organisers and/or its affiliates against, any loss (including indirect and consequential loss) howsoever arising which may be suffered in relation to participation in an audition, whether caused by any negligent act or omission or any default on the part of any party or otherwise.
6.4 The participant warrants that he/she has the capacity to agree to these terms and conditions and further that, if successful, such participant is at complete liberty to participate in being the host of Our Perfect Wedding and to comply with these terms and conditions and that doing so will not infringe upon the rights of any other person.
6.5 The Organisers reserve the right to disqualify any participant should the abovementioned warranties not be complied with and/or if any other provision in the terms and conditions are not complied with.
6.6 By attending the audition for Our Perfect Wedding Presenter Search, each participant accepts and agrees to abide by the terms and conditions set out herein and any other such rules and conditions that the Organisers may issue in relation to further phases of Our Perfect Wedding Presenter Search from time to time.
6.7 These terms and conditions are governed by South African law and the South African courts shall have sole and exclusive jurisdiction in respect of all matters (including disputes) arising from these terms and conditions.
If any of these terms and conditions are not adhered to, your entry will be considered incomplete and will be regarded as null and void.
IN ADDITION TO THE ABOVE, PLEASE COMPLETE AND SIGN THE BELOW SECTIONS:
7. Use of Personal Information
I, __________________________________________________________ [insert full name) consent to the use of any personal information supplied by me to the Organisers for the purposes of establishing whether I am a suitable candidate and for selecting contestants for the production of Our Perfect Wedding Presenter Search. I hereby irrevocably assign to the Organisers the entire copyright and all other rights, including all intellectual property rights, of whatsoever nature in and to my audition and contribution to Our Perfect Wedding Presenter Search whether now in existence or arising in the future, including without limitation, my performance, any comments ascribed to me, as part of the audition or otherwise, any interview and any inclusion of my photographs, likeness, profile, voice, sound effect, caricature, literary, artistic and musical materials and the like for purposes of Our Perfect Wedding Presenter Search and/or any related publicity, research and marketing, which the Organisers hereby accept. The Organisers shall therefore be entitled to use and exploit and licence others to use and exploit such contributions, in whole or in part, by all means and in all media, manner and formats whether now known or hereafter invented throughout the world and in perpetuity.

8. Acknowledgements and Confirmation by the Participants
8.1 I am aware that the Organisers will consider the information supplied by me in this document for purposes of considering me as a host in Our Perfect Wedding.
8.2 I have answered all the questions on the audition form fully, honestly and accurately and I confirm that I have not misled or attempted to mislead the Organisers in any respect as to my identity, experiences or in any other way;
8.3 If any of the information I have provided in the questionnaire is found to be false, the Organisers will be entitled to immediately exclude me from further participation in the auditions and/or as a host of Our Perfect Wedding
8.4 If I am short-listed, I also agree to authorise the Organisers to conduct background checks to verify any of the information I have supplied.
8.5 I understand that consenting to these terms and conditions and completing the questionnaire below is no guarantee that I will be chosen to participate as the host of Our Perfect Wedding.
8.6 If my audition is successful, the Organisers have no obligation to produce an episode of Our Perfect Wedding that I may be in and, even if done so, there will be no obligation on the Organisers or any broadcaster to broadcast it.
8.7 All decisions by the Organisers concerning selection of the participants are final and no reasons will be given. No deliberations may be entered into and no decisions may be taken on review.
8.8 By participating in the audition and, if relevant, in Our Perfect Wedding Presenter Search, I accept and agree to abide by these terms and conditions set out herein and such rules and conditions that the Organisers may issue in relation to the audition and all further phases of Our Perfect Wedding Presenter Search from time to time.
8.9 I hereby assign to the Organisers the right to use my photographs, likeness, profile, voice, sound effect, caricature, literary, artistic and musical materials and the like for purposes of Our Perfect Wedding Presenter Search and/or any related publicity and marketing, which the Organisers accept.
8.10 I am not a disqualified person and am entitled to participate in the audition and, if selected, as the host of Our Perfect Wedding.
